Karnataka Act No. 45 of 2026, the Karnataka Apartment (Ownership and Management) Act, 2026, received the Governor's assent on 9 October and was first published in the Karnataka Gazette Extra-ordinary on 15 October. The Act does not identify 15 October as its commencement date: section 1(2) makes commencement subject to a date the State Government may appoint by Official Gazette notification. The official Act text records both dates and the separate commencement mechanism.
The Gazette text reviewed here does not appoint 15 October as the commencement date. BestProp.ai's exact-title and commencement-notice searches on the official e-Gazette site on 21 October did not identify a later date-appointing notification. The search was not an exhaustive audit of every Government notice, so owners and committees should check the latest Official Gazette before treating any commencement-based duty or deadline as active.
Why the wording matters
A same-day report described the Gazette announcement as bringing the law into force. But section 1(2) in the enacted text makes commencement depend on a date appointed by the State Government. The Gazette publication confirms the Act was published; by itself, that date is not the appointed date described in section 1(2). The Times of India's 15 October report is useful context for the wording readers may encounter, while the official statutory text controls this date distinction.
What the coverage clause does and does not settle
Section 1(3) describes projects with more than eight apartments in one or more buildings, including some villas under single-plot or development-plan approvals, and projects over eight apartments on sites in section 17-approved layouts. Sections 1(4) and 1(5) add exclusions and qualifications. The apartment count alone therefore does not determine whether a particular community falls within the Act. The scope clauses are on pages 56–57 of the official Gazette text.
For a building-specific question, keep three checks separate: identify the project category in section 1; confirm the latest Government notification appointing commencement; and read the exact provision for the event that starts its deadline. Do not count from assent or publication unless that provision's trigger supports it.
The commencement question is separate from occupancy documentation. BestProp.ai's Karnataka occupancy-certificate coverage explains why a reported OC route does not establish the full compliance history of a building.
Questions apartment owners are asking
Has the Karnataka Apartment Act 2026 commenced?
Section 1(2) says the Act comes into force on a date the State Government may appoint by Official Gazette notification. BestProp.ai's 21 October searches did not identify an appointment notice, but the search was not exhaustive. Check the latest official Gazette before relying on a status summary.
Does more than eight apartments automatically mean the Act applies?
No. Section 1(3) describes qualifying planning-approval categories, while sections 1(4) and 1(5) state exclusions and qualifications. The Act text must be matched to the project's records.
Should an association start a statutory timeline from 15 October?
Do not assume that. First verify the appointed commencement date and then read the particular provision's trigger. A publication date is not a substitute for that check.
Sources and limits
The primary source is Karnataka Act No. 45 of 2026 in Gazette No. 1144, Part IVA, especially sections 1(1)–(5), printed pages 55–57. The publication and assent dates come directly from the Gazette. The Times of India report is cited only as time-bounded context for the wording readers may encounter, not as a substitute for the Act. The commencement-notice search was not exhaustive, and this article does not decide the law's current application to any named building. This is general information, not legal advice.
